A Los Angeles County judge has granted Olivier Martinez a temporary restraining order against his ex-wife Halle Berry after the actor accused the Oscar-winning star of physically abusing their 12-year-old son, Maceo, according to court documents reviewed.
The protective directive orders Berry to stay at least 100 yards away from Martinez, though she is still permitted to see her preteen son. However, the ruling adjusts their standard custody terms, restricting Berry’s parenting time with Maceo to Mondays and Tuesdays from 10 a.m. to 8 p.m., alongside Saturdays and Sundays during the same timeframe. The judge noted that partial parenting time remains active to preserve ties between mother and child, while simultaneously turning down a motion to subject Berry to mandatory sobriety monitoring due to a lack of concrete evidence.

In court papers highlighted by Variety, Martinez claimed that an argument on September 26 at Berry’s residence turned physical when the actress allegedly jumped on the boy and placed him in a chokehold. He has asked the court to grant him sole legal and physical custody of Maceo.
Berry’s attorney, Marina Beck, pushed back hard against the allegations, describing the filing as entirely unfounded and deliberately misleading. Beck stated that extensive documentation shows Martinez has repeatedly breached past judicial rulings and blocked important educational and therapeutic support for Maceo, resulting in prior legal sanctions against him. Beck remarked that this kind of behavior from Martinez is unsurprising given his history, and Berry will continue focusing on her son’s best interests.
The pair met in 2010 on the production of Dark Tide, married in 2013, and had Maceo later that year. They announced their separation in October 2015, and their divorce was finalized in 2023. Berry also shares an 18-year-old daughter named Nahla with former partner Gabriel Aubry.
